Please read these terms before using our website. They're the ground rules for everyone who visits thinkpickle.com.au or any website or online portal we own or operate, including my.thinkpickle.com.au (together, the "Pickle Websites").

Your use of the Pickle Websites is subject to:

In these Terms, references to "Pickle", "we", "us", and "our" are references to Pickle Pty Ltd ABN 36 165 711 731 (trading as Pickle), of Office 12, 7-9 Churchill Ave, Strathfield NSW 2135.

By using a Pickle Website, you accept these Terms and agree to be bound by them. If you do not agree, please do not use our websites.

2. Access to Our Websites

Our websites are publicly accessible. Some areas — including the Pickle customer portal at my.thinkpickle.com.au — require you to register or log in with an account.

Where account access is required:

  • you are responsible for keeping your login credentials confidential;
  • you are responsible for all activity carried out under your account, including activity by others using your credentials;
  • you must notify us immediately at [email protected] if you suspect unauthorised access to your account; and
  • we may suspend or terminate account access if we reasonably believe credentials have been compromised.

3. What You Can and Can't Do

You may:

  • browse and use the Pickle Websites for your own lawful purposes;
  • share links to pages on the Pickle Websites; and
  • download content we have made available for download, for your personal or internal business use.

You must not use the Pickle Websites to:

  • (a) do anything unlawful, fraudulent, or that breaches any Australian law or regulation;
  • (b) infringe the intellectual property rights, privacy, or other rights of any person;
  • (c) upload, transmit, or distribute viruses, malware, ransomware, or any other harmful code;
  • (d) tamper with, interfere with, or make unauthorised modifications to any Pickle Website or its underlying systems;
  • (e) conduct or facilitate denial-of-service attacks, network scanning, or other disruptive activity;
  • (f) attempt to gain unauthorised access to any account, system, or data;
  • (g) defame, harass, threaten, menace, or offend any person;
  • (h) transmit obscene, indecent, inflammatory, or otherwise objectionable material; or
  • (i) use the Pickle Websites in any way that inhibits any other person from using them.

You must not permit or encourage another person to do any of the things listed above.

4. Content You Submit

This section applies if you submit, upload, post, or otherwise make any content available through a Pickle Website — for example, via a contact form, enquiry, or feedback submission.

By submitting content:

  • you grant us a non-exclusive, irrevocable, royalty-free, worldwide licence to use, reproduce, modify, adapt, publish, and communicate that content for the reasonable purposes of our business;
  • you warrant that you have the right to grant that licence and that the content does not infringe any third party's rights and is not defamatory or unlawful; and
  • you consent to any act or omission that would otherwise infringe your moral rights in the content.

We may monitor, review, edit, or remove any content you submit at any time, including to protect the operational integrity of our websites. We are not obliged to monitor all submitted content.

5. Suspension or Termination of Access

We may suspend or terminate your access to all or any part of the Pickle Websites at any time without notice if, in our reasonable opinion, you have breached these Terms or our Acceptable Use Policy.

For account-based services (including my.thinkpickle.com.au), we may also suspend access where:

  • your account is in arrears or your service agreement has been terminated; or
  • suspension is required by law or by a direction from a regulatory authority.

6. No Warranties or Representations

To the maximum extent permitted by law, and subject to the Australian Consumer Law provisions in these Terms:

  • we do not represent or warrant that the content on the Pickle Websites is accurate, complete, reliable, or suitable for any particular purpose;
  • we do not represent or warrant that the Pickle Websites will be continuously available, free from errors, or free from viruses or other harmful components; and
  • we may change, suspend, or discontinue any part of the Pickle Websites at any time without notice.

7. Our Liability to You

What we are liable for: We may be liable to you for breach of contract or negligence under the principles applied by the courts. Nothing in these Terms limits any right you may have under the Australian Consumer Law.

What we are not liable for: To the maximum extent permitted by law:

  • we are not liable for any loss or damage caused by you or that results from your breach of these Terms;
  • we are not liable for loss of revenue, profit, business opportunity, data, or goodwill arising from your use of the Pickle Websites;
  • we are not liable for indirect, special, incidental, or consequential loss of any kind; and
  • we are not liable for any loss arising from your reliance on the accuracy or completeness of content on the Pickle Websites.

If we are not entitled by law to exclude a particular liability (including any non-excludable consumer guarantee under the Australian Consumer Law), then to the extent permitted, we limit that liability to the re-supply of the relevant information or services.

Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified by agreement.

9. Your Liability to Us

You are liable to us for any loss or damage we suffer as a result of your breach of these Terms or your negligence, except to the extent that the loss is caused by us.

The Pickle Websites may contain links to third-party websites. Those links are provided for your convenience only. We do not endorse, and are not responsible for, the content, products, services, or practices of any third-party website. You access third-party websites entirely at your own risk, subject to their own terms.

11. Linking to Our Websites

You may create a link to a page of a Pickle Website. However, you must not:

  • display any page of a Pickle Website in a framed, altered, or distorted format;
  • create a link from any website that contains content that is unlawful, offensive, or that exposes us to risk of civil or criminal liability;
  • create a link in a way that implies or falsely suggests that we sponsor, endorse, or are affiliated with your website, product, or service; or
  • use our trade marks or branding in any link without our prior written consent.

We reserve the right to withdraw linking permission at any time.

12. No Waiver

If we do not act in relation to a breach of these Terms by you, we do not waive our rights to act in relation to that breach or any future breach.

13. Inconsistency

If there is an inconsistency between these Terms and any other terms displayed on a specific page of a Pickle Website, the page-specific terms will govern to the extent of the inconsistency.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.

This Copyright and Trade Mark Notice applies to thinkpickle.com.au, my.thinkpickle.com.au, and all other websites owned or operated by or on behalf of Pickle Pty Ltd ABN 36 165 711 731 (each a "Pickle Website").

Our Content

All copyright and other intellectual property rights subsisting in the Pickle Websites and the material on them — including software, design, text, graphics, photography, video, and the selection and layout of pages — are owned by or licensed to Pickle Pty Ltd and are protected under the Copyright Act 1968 (Cth) and the laws of Australia.

You are authorised to view the Pickle Websites and their contents using your web browser. You must not otherwise reproduce, copy, transmit, adapt, distribute, sell, modify, publish, or use any material from the Pickle Websites without our prior written consent, except as expressly permitted by the Copyright Act 1968 (Cth) or as we have expressly invited you to do (for example, sharing specific content we have made available for sharing).

Trade Marks

The Pickle Websites include registered trade marks owned by Think Pickle Pty Limited and protected under the Trade Marks Act 1995 (Cth), including:

  • THINK PICKLE — Word mark — Registration No. AU 1981943 — Class 38
  • pickle. (logo) — Composite mark — Registration No. AU 1981944 — Class 38

Both trade marks were registered by IP Australia on 3 November 2020 and are valid until January 2029.

You must not use any of these trade marks, the names "Think Pickle", "Pickle", or "thinkpickle.com.au", or any confusingly similar name, mark, or logo, without our prior written consent.

Third-Party Content

Some content on the Pickle Websites may be sourced from third parties and is subject to those parties' copyright and terms of use. Such content is used for the purposes contemplated by our arrangements with the relevant rights holders and must not be reproduced, redistributed, or stored except for personal, non-commercial use permitted by those arrangements.
